Case Law No. 25/2018/AL on exemption from deposit penalty due to objective reasons
A deposit contract to secure the conclusion of a house sale agreement stipulates that, within a specified period, the deposit recipient must complete the procedures to obtain a certificate of house ownership; otherwise, they must pay a deposit penalty. Upon expiration of the agreed period, the deposit recipient has not been granted the certificate of house ownership due to reasons attributable to a competent state authority. In this case, it must be determined that the recipient’s failure to perform the commitment is due to objective reasons, and therefore, the deposit recipient is not subject to the deposit penalty.
